Virginia: Medical Malpractice – a Lawyer’s Recusals

On September 25, 2013, pursuant to the Judicial Disqualification Policy, the Chief Judge of the Seventh Judicial Circuit designated Judge Pugh to preside over the medical malpractice lawsuit captioned George Rauchfuss v. Roger E. Schultz, M.D., Roger E. Schultz, M.D., Hampton Roads Urology, Riverside Physician Services, Inc., Riverside Medical Group, Benjamin J. Pettus, M.D., Peninsula Radiological Associates, Ltd., Riverside Diagnostic Center – Williamsburg, Riverside Hospital, Inc., Riverside Health System, and Riverside Healthcare Association, Inc., No. CL1302754V-04. Previously, Judge Conway and then Judge Tench had recused themselves from presiding.

The recusals occurred during the pendency of Patient’s Motion to Enforce Va. Code Ann. §8.01-413(C) Subpoena Duces Tecum, which seeks all factual information of patient care being withheld by Defendant healthcare provider, Riverside. That medical malpractice Motion should be heard in Circuit Court for the City of Newport News in November, 2013.
