Virginia: Medical Malpractice – a Lawyer’s Speech

On January 20, 2015, Mr. Waterman is guest speaker of the Greater Peninsula Women’s Bar Association (“GPWBA”) in Newport News. His topic is “’It’s Privilege, Judge’: In Fact, Actually Not!,” subtitled “Medical Malpractice ‘Privilege’ Law”.

Mr. Waterman’s speech to GPWBA debunks “privilege” claimed by the defense in three key medical malpractice contexts: (1) Risk Management materials; (2) policies, procedures, and protocols; and (3) audit trails and metadata. He also addresses cutting-edge dynamic interactive videotape depositions, followed by a question-and-answer session.

His principal statutory authorities are Va. Code §8.01-413 and §32.1-127.1:03 and Federal HIPAA and HITECH. He also covers his leading cases: Riverside, Rauchfuss, Eason, Cherrie, Whitby, Peck, and Temple.
