Virginia: Nursing Homes – a Lawyer’s Wounds

On May 3, 2018, the Honorable Michael E. McGinty denied Defendant nursing home’s Demurrer and upheld Plaintiff’s pleading for punitive or exemplary damages, based principally on local DSS Adult Protective Services’ investigation/determination of “abuse, neglect or exploitation” and need for protective services at the nursing home due rapid development of severe pressure wounds there that required emergent hospitalization and surgical intervention.  The medical malpractice case is Brandveen v. Envoy of Williamsburg, LLC, No. CL 18-000053-00 in Circuit Court for the City of Williamsburg and James City County, Virginia.
