13 Nov Virginia: Medical Malpractice – A Lawyer’s Certification
By Opinion and Order entered July 10, 2020, United States District Court for the Western District of Virginia held that Virginia’s medical malpractice “expert certification requirement does not apply in federal court,” that “Va. Code Ann. §8.01-20.1 does not apply in federal court.” Therefore, the Court denied Defendant’s motion to dismiss for Plaintiff’s lack of expert certification of his wrongful death suit for damages. The case is Andes v. United States, 2020 U.S. Dist. LEXIS 121659, 2020 WL 3895780 (W.D. Va. Jul. 10, 2020).
