24 Oct Virginia: Medical Malpractice – a Lawyer’s Radiologist
By Order entered September 5, 2017, Circuit Court for the City of Petersburg, Virginia, ruled over objection that Plaintiff is entitled to question the medical malpractice Defendant radiologist about what he presently sees on imaging at the time of deposition, i.e., to elicit “retrospective opinions or current impressions”. The case is Moore v. Radiology Associates of Richmond, Inc. No. CL15-822, and expressly finds Toraish v. Lee, 293 Va. 262 (2017), controlling. Id. at 1.
