Virginia: Special Cases – a Lawyer’s USDOJ

On February 10, 2016, the United States Department of Justice (“USDOJ”) announced that it sued Dr. Labib E. Riachi and his two companies, Riachi, Inc. and Center for Advanced Pelvic Surgery, LLC, all of New Jersey, for “knowingly submitting millions of dollars in false claims in Medicare and Medicaid for thousands of diagnostic tests that never were performed and for physical therapy services performed by unqualified personnel”. Per the USDOJ’s Complaint: “For many years, Dr. Labib E. Riachi was one of the nation’s most prolific Medicare billers of anorectal manometry [and] for a certain type of electromyography”.

The USDOJ is suing inter alia pursuant to the False Claims Act, which also provides for “whistleblowers” – who often are current or former employees of the perpetrator – to be paid substantially for exposing healthcare and other fraud.
