14 Mar Virginia: Car Accident – a Lawyer’s Tire
On March 9, 2018, a Richmond jury awarded $37,800,000.00 to a cement mixer truck accident victim who was rendered a quadriplegic because of defective tire tread separation. The case is Benedict v. Hankook Tire Co., Ltd., No. 3:17-cv-109 in United States District Court for the Eastern District of Virginia.
On November 27, 2017, presiding Judge Payne denied summary judgment to the defendant tire manufacturer in Benedict. On February 6, 2018, the Judge filed his lengthy Memorandum Opinion supporting that denial, which is “must reading” for Virginia product liability law. 2018 WL 738901, 2018 U.S. Dist. LEXIS 19701, 19702, and 19737.
