Virginia: Special Cases – a Lawyer’s Fee

By Unpublished Order on January 30, 2015, the Virginia Supreme Court in Landini v. Bil-Jax, Inc., affirmed the dismissal with prejudice of a personal injury lawsuit by the Circuit Court for Powhatan County, Virginia. It held that the suit was time-barred because Plaintiff failed to pay $2.00 of the Court’s Clerk filing fee (for the Court library) until after the statute of limitation had expired, even though the Complaint and the other $344.00 of the filing fee were received by the Court Clerk in time. Id. at 1-3.
