On December 21, 2018, the United States Court of Appeals for the Sixth Circuit held unconstitutional Tennessee’s $700,000.00 statutory cap on punitive damages, upholding the jury’s punitive damages award of $3,000,000.00. The case is Lindenberg v. Jackson Nat’l Life Ins. Co., No. 17-603416079. Virginia’s $350,000.00 statutory cap on punitive damages and its statutory cap on medical malpractice damages are unconstitutional and should be struck down too.
