$425,000.00 Military Medical Malpractice Settlement for Wrong Site Surgery

On August 19, 2026, Avery T. “Sandy” Waterman, Jr., Esq. of Waterman Law Centers settled a medical malpractice claim for wrong site surgery for $425,000.00 under the SFC Richard Stayskal Military Medical Malpractice Act of 2019. Unfortunately, under that relatively new military Act, medical expenses cannot be claimed, and non-economic damages currently are “capped” at only $750,000.00 – less than 1/3 and closer to 1/4 of Virginia’s Medical Malpractice Act “cap” – which creates quite a “glass ceiling” for claim valuation. The claimant military officer alleged substandard care by another military officer, a surgeon at a local military base hospital.
