On October 25, 2017 the United States Court of Appeals for the 4th Circuit affirmed the $2,750,000.00 jury award in the wrongful death case of Bagheri v. Bailey, No. 16-1712. Notably, the Fourth Circuit in Bagheri held that there was no abuse of discretion by United States District Court for the Western District of Virginia at Abingdon ruling that there was no prejudice to the medical malpractice Defendant doctor by several jurors seeing television and/or Facebook reports of the trial and the doctor, where the jurors stated they still could be impartial and the judge gave a special instruction to disregard the news reports.
