Virginia: Medical Malpractice – A Lawyer’s OCR

The United States’ Office of Civil Rights (“OCR”) announced substantial monetary settlements paid by 7 healthcare providers who violated patients’ HIPAA rights of access to their healthcare records. Bayfront Health St. Petersburg paid $85,000.00; Korunda Medical paid an undisclosed amount; All Inclusive Medical Services (“AIMS”) will pay $15,000.00; Northeast Behavioral Health Corporation d/b/a Beth Israel Lahey Health Behavioral Services (“BILHBS”) will pay $70,000.00; Housing Works will pay $38,000.00; Wise Psychiatry will pay $10,000.00; and King MD – a small Virginia provider – will pay $3,500.00.

Mr. Waterman uses HIPAA to collect patient records for his clients in motor vehicle accident, medical malpractice, and other cases of wrongful death or personal injury. He reports non-compliant healthcare providers to OCR for investigation, prosecution, and penalization for their HIPAA disclosure violations.
