Virginia: Medical Malpractice – a Lawyer’s Venue (December 6, 2018)

Mr. Waterman recently received a pair of Orders from Fairfax Circuit Court denying transfer to Prince William Circuit Court in companion medical malpractice cases for ostensible “substantial inconvenience,” pursuant to Va. Code § 8.01-265.  The lawsuits are the personal injury claim in Perez v. Potomac Hosp., No. CL-2005-3149, and the wrongful death claim in Perez as Personal Representative of the Estate of Vanessa Zuleynna Ventura v. Potomac Hosp., No. CL-2005-3150.  In Perez, the Defendant pediatrician had offices and treated patients in Fairfax and the Defendant pediatrics practice had offices and its registered agent in Fairfax, while the Defendant hospital was located in Prince William County and the 5 Defendant nurses resided in Fredericksburg, Woodbridge, Stafford, and Dale City.  See, Plaintiff’s Response to Defendants’ Motion to Change Venue at 2.
