Virginia: Special Cases – a Lawyer’s Bill

By Order entered September 21, 2018, in Adams v. Children’s Hospital of the King’s Daughters, No. CL2018-2656 in Circuit Court for the City of Norfolk, Virginia, Judge Lannetti overruled in pertinent part the dilatory Demurrer of Defendant CHKD. Adams found that a Complaint stated claims for defamation and Virginia Consumer Protection Act [“VCPA”] violation, where CHKD wrongfully billed the victim Plaintiff (who was not its patient), referred the bill for third-party debt collection, and asserted victim responsibility for the bill.
