02 Feb Virginia: Special Cases – a Lawyer’s Radiologist
On January 29, 2016, the United States Department of Justice announced that Rose Radiology Centers, Inc. of Tampa, Florida – the “official” radiology practice of the Tampa Bay Rays and the Tampa Bay Lightning – agreed to pay $8,710,000.00 to the United States for its alleged violations of the False Claims Act. Of that, $1,700,00.00 will be received by 2 “whistleblowers” – a radiology technician and a collection/billing employee – who exposed their employer’s alleged fraud through qui tam lawsuits by private civil litigation lawyers.
The multi-prong allegations of radiologist wrongdoing were: (1) knowingly submitting federal health care claims for MRI scans using contrast dye without the physician supervision required because of potential anaphylactic shock; (2) improperly billing for radiology procedures impermissibly referred by chiropractors as if they were ordered by Rose Radiology itself; (3) performing and billing for additional procedures not ordered by requesting providers; (4) performing radiology services at locations not authorized by Medicare and billing them as if performed at authorized locations; and (5) giving kickbacks to referring physicians to solicit more referrals. Such alleged kickbacks violate the Anti-Kickback Act and the Stark Law.
