By Memorandum Opinion entered December 10, 2019, United States District Court for the Western District of Virginia found “as a matter of law” that an offending tractor trailer truck driver acted within the scope of his employment with the Defendant trucking company when he drank alcohol before driving on-the-job and causing a car crash and personal injuries. Hence the Court granted Plaintiff’s motion for partial summary judgment on the point. The case is Laporsek v. Burress, 2019 U.S. Dist. LEXIS 212193, 2019 WL 6718098 (W.D. Va. Dec. 10, 2019).
