On July 22, 2021, the Virginia Supreme Court issued its wrongful death decision in Potter v. BFK, Inc., Record No. 191716. It reversed and remanded the Circuit Court erroneously sustaining a plea in bar, finding that the equipment at issue was not ordinary building material subject to Virginia’s statute of repose, Va. Code §8.01-250.
