By 3-page Order entered November 4, 2021, Stafford County Circuit Court decided as a “first impression” legal issue that a victim patient pursuing a claim against a doctor participating in the Virginia Birth-Related Neurological Injury Compensation Program does not preclude the patient also being a medical malpractice plaintiff against non-participating healthcare providers. The case is Etchieson v. Dalke, No. CL21-1675.
