By Order entered July 29, 2020, Circuit Court for Henrico County, Virginia ruled that the medical malpractice Plaintiff was entitled to question the Defendant pathologist at deposition for his current interpretation of the patient’s pathology slides. It found the Defendant “is being asked about his observations of a fact”, “not ‘opinion’ testimony that the defendant is being asked to offer against himself”. The case is Hutchinson v. Bridges, No. CL19-3478.
