In its Unpublished Order in Mattejet v. Blosser, Record No. 201021, the Virginia Supreme Court reversed and remanded for retrial the trial judge’s erroneous grant of the offending truck driver Defendant’s Motion to Strike the Evidence after the Plaintiff’s case-in-chief in a wrongful death case. The Mattejet Court held that the offending motorist’s oral statement and his written statement “presents a prima facie showing of negligence” vis-à-vis the victim motorcyclist in the vehicle crash. Id. at 5.
